Terms of Use

Section 1Agreement and scope

These Terms of Use (the “Terms”) govern the Hiitv iOS application and any Hiitv-operated pages, account functions, playback tools, and support channels that link to them (together, the “Service”). “Hiitv,” “we,” and “us” refer to the operator of the Service.

By installing, opening, registering for, or otherwise using the Service, you accept these Terms. If you do not accept them, you must not use Hiitv. Our Privacy Notice explains our data practices, and our Membership & Billing Terms apply to paid products.

Section 2Who may use Hiitv

You must have legal capacity to enter this agreement where you live. A user who has not reached the local age of majority may use Hiitv only with a parent or legal guardian’s permission and supervision. Hiitv is not intended for children under 13.

Section 3Your account

• Give accurate registration and recovery information and keep it current.
• Keep passwords, verification codes, devices, and active sessions secure.
• Do not sell, lease, transfer, or provide account access to another person unless Hiitv expressly permits it.
• Tell us promptly if you believe an account has been compromised.
• You are responsible for activity performed through your account unless applicable law provides otherwise.

Section 4What the Service provides

Hiitv may provide entertainment discovery, streaming or playback, search, watch history, favorites, recommendations, member benefits, and related features. The catalog and functionality can differ by territory, plan, device, app release, licensing arrangements, and network conditions. No particular title or feature is promised to remain available.

Section 5Your permission to use the app

While you comply with these Terms, we give you a limited, revocable, personal, non-exclusive, and non-transferable permission to use Hiitv on Apple-branded devices that you own or control, subject to Apple’s App Store Usage Rules. This permission is for private, non-commercial use. It does not transfer ownership of the app, its design, software, trademarks, catalog information, or any media made available through it.

Section 6Conduct that is not allowed

You may not:

• Use Hiitv in connection with unlawful, deceptive, abusive, harmful, or rights-infringing activity.
• Record, copy, redistribute, sell, publicly perform, or commercially exploit media except with authorization from the relevant rights holder.
• Defeat geographic controls, digital rights management, access restrictions, membership validation, or other protective measures.
• Reverse engineer, probe, overload, disrupt, or introduce malicious code into the Service.
• Use scraping software, crawlers, bots, or automated requests without our written approval.
• Impersonate another person, obtain unauthorized access, or misuse another person’s information.

Section 7Paid products

Apple processes purchases made in the iOS app. The Apple purchase screen presents the price, currency, duration, renewal conditions, and any introductory offer before you approve a transaction. You are responsible for reading that information. Deleting the app or closing a Hiitv account does not itself stop an Apple subscription.

Section 8External services

Hiitv may use or link to third-party infrastructure, advertising, analytics, authentication, payment, content, or websites. Those parties may apply separate terms. We do not control their independent services and are not responsible for them beyond what applicable law requires.

Section 9Changes, suspension, and closure

We may maintain, change, restrict, or retire parts of Hiitv for product, licensing, security, legal, or technical reasons. We may suspend or close access connected with fraud, nonpayment, serious or repeated violations, security threats, legal demands, or harm to other users or the Service. You may stop using Hiitv at any time and may request account deletion.

Section 10Service disclaimers

To the fullest extent allowed by law, Hiitv is offered “as is” and “as available.” We do not promise that the Service will always be uninterrupted, error-free, or available in every location. We do not exclude any warranty or consumer protection that cannot legally be excluded.

Section 11Limits on liability

To the fullest extent allowed by law, Hiitv and its operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including lost data, revenue, profits, goodwill, or opportunity, arising from use of or inability to use the Service. This clause does not limit liability that the law does not permit us to limit.

Section 12Terms specific to Apple

This agreement is between you and Hiitv, not Apple. Hiitv, rather than Apple, is responsible for the app, its maintenance and support, and addressing claims relating to it. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.

Hiitv, not Apple, is responsible for handling claims concerning the app or your possession and use of it, including product-liability claims, claims that the app fails to meet legal or regulatory requirements, consumer-protection claims, and third-party intellectual-property claims. You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on a United States government prohibited or restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them after your acceptance.

Section 13Disputes and applicable law

The laws applicable to Hiitv’s operator govern these Terms, disregarding conflict-of-law rules, except where mandatory law in your place of residence says otherwise. Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the issue. A dispute that remains unresolved may be brought before a court or authority with lawful jurisdiction.

Section 14Updates to these Terms

We may revise these Terms when the Service, law, security needs, or platform requirements change. The effective date at the top identifies the current version. We will provide additional notice when required. Continued use after revised Terms take effect signifies acceptance where the law allows.
